Payment Scope and Application Method for Industrial Accident Compensation Insurance



Is a foreign worker who has been injured in an occupational accident eligible for insurance benefits from industrial accident compensation insurance?



In principle, the Industrial Accident Compensation Insurance Act applies to every business that employs workers, irrespective of the nationality of its workers. Thus, foreign workers injured in an occupational accident may be eligible for insurance benefits under industrial accident compensation insurance.



However, the Industrial Accident Compensation Insurance Act does not apply to businesses subject to the accident compensation scheme pursuant to the Seafarers' Act, the Act on Accident Compensation Insurance for Fishers and Fishing Vessels, or the Private School Teachers’ Pension Act, etc. In addition, the Industrial Accident Compensation Insurance Act does not apply to employment activities within households and/or businesses in the agricultural, forestry (excluding the logging industry), fishery, or hunting sector with less than 5 regular workers.



To apply for industrial accident compensation, submit a completed application for medical care expenses. Any person who is dissatisfied with a decision on insurance benefits made by the Korea Workers’Compensation and Welfare Service may (1) request an examination. Any person who is dissatisfied with the results of the examination may (2) file a request for reexamination.
