Victims of Sexual Offenses Penalties for Commercial Sex Acts


 


Q. I was coerced into commercial sex acts at a commercial sex acts establishment. Will I be punished along with the business owner?


 


A. Commercial sex acts, the arrangement of commercial sex acts, and human trafficking for the purpose of commercial sex acts, etc. are punishable. However, commercial sex acts done by a victim of commercial sex acts are not.


 


Scope of Victims of Commercial Sex Acts Scope A person coerced into commercial sex acts by a deceptive scheme, force, or equivalent means A person who engaged in commercial sex acts while addicted to narcotics, psychotropic drugs, or cannabis by a person supervising or protecting the person because of a business, employment, or other relationship A younger individual, a person having no or weak discernment or decision-making capacity, or a person provided for in the attached Table of the Enforcement Decree of the Act on the Punishment of Arrangement of Commercial Sex Acts, or an equivalent person who cannot sustain a normal everyday or social life without the protection and supervision of another person and is, therefore, vulnerable to wrongful pressure, deception, or enticement by others, any of whom is solicited or enticed to engage in commercial sex acts A person who was trafficked for the purpose of commercial sex acts


 


Scope of Victims of Commercial Sex Acts A person who voluntarily engaged in commercial sex acts at a commercial sex act establishment is not a victim of commercial sex acts and is punished under the relevant laws.
