Q. What happens if a person refuses a breath test required by a police officer?


 


A. Refusing a breath test required by a police officer is a punishable offense. Any person who refuses a breath test required by a police officer may have his/her driver's license revoked, and is punishable by imprisonment with labor for not less than 1 year but not more than 5 years or by a fine not less than 5 million won but not exceeding 20 million won.

PENALTY! Aggravated penalties apply if a person is injured by drunk driving. Any person who causes injury to any other person by driving a motor vehicle (including a motorcycle) under the influence of alcohol shall be punished by imprisonment with labor for not less than one year but not more than 15 years or by a fine of not less than 10 million won but not more than 30 million won, and a person who causes death of any other person by doing the same shall be punished by imprisonment with labor for an indefinite term or not less than three years.
