Investigation Procedure  for Assault Cases


 


How is an assault case processed?


 


Procedure for Criminal Cases. Criminal cases are generally processed as follows.”  Arrest: Apprehension or detention of suspect when the suspect does not have a definite residence or there is a concern that the suspect may refuse to appear for investigation, destroy evidence, or attempt to escape  Booking: A criminal case established as the suspect is accused of a crime , Forwarding: Sending the suspect and related x-documents from an investigating agency to the prosecutor’s office or from a prosecutor’s office to another prosecutor’s office


 


Criminal complaint: A criminal victim or a complainant reports a crime to the investigative institution. Accusation: A third party other than the culprit or victim reports a crime to the investigative institution. Self-denunciation: A culprit turns himself or herself into the investigative institution. Report: Anyone informs the investigative institution of a crime. Acknowledgment: The investigative institution identifies a criminal case through rumors, intelligence, arrest of the culprit, etc.


 


Arresting the suspect:  The investigative institution detains a suspect with an arrest warrant issued by a judge when there is good reason to believe that the suspect has committed crime and the suspect fails to comply or is likely to fail to comply with the investigative institution’s request to appear without justifiable reasons.                  Putting the suspect under detention: As a result of the criminal investigation, the investigative institution arrests the suspect by an arrest warrant issued by a judge when there is good reason to believe that the suspect has committed a crime, has no definite residence, or may attempt to destroy evidence or escape.
